PRIVACY POLICY

Cottrell, Inc.(referred to as “Cottrell,” “us” or “we”) operates a mobile application (the “Application”). It is Cottrell’s policy to respect the privacy of the Application’s users (“you”, “your”) regarding any information collected through the Application. This privacy policy (the “Privacy Policy”) discloses the privacy practices for the Application. This Privacy Policy also covers how personal and other information that we receive or collect about you is treated. If you do not understand any aspects of our Privacy Policy, please feel free to contact us as described at the end of this Privacy Policy.

You acknowledge that this Privacy Policy is designed to be read in connection with the Application’s Terms and Conditions of Use (“Terms”), which is available on the Application, and that by accessing or using the Application, you agree to be bound by the Application’s Terms, as well as this Privacy Policy.

IMPORTANT: BY USING THE APPLICATION, YOU GIVE YOUR CONSENT THAT ALL PERSONAL DATA THAT YOU SUBMIT MAY BE PROCESSED BY US IN THE MANNER AND FOR THE PURPOSES DESCRIBED BELOW. IF YOU DO NOT AGREE TO THE APPLICATION’S TERMS AND TO THE PRIVACY POLICY SET FORTH HEREIN, DO NOT USE THE APPLICATION.

  1. Types of Information We Collect.
    • Information you Provide to Us: Personally Identifiable Information. We collect certain personal information when you provide it to us, such as when personally identifiable information is voluntarily provided when you use the Application, register for an account, and when you electronically communicate with us. This information may consist of the following: your name, email address, company name, shipping address, tractor and trailer VIN numbers and preferred language. The information you voluntarily supply may be used by us to respond to your inquiries, supply you with requested information on our services, and/or to issue reminders for or to track appointments you have made with us. Your information is considered private and confidential and treated with the strictest confidence.
    • Information We Collect Automatically: Non-Personally-Identifying Information. Cottrell collects or may have a third-party service provider collect, non-personally-identifying information of the sort that mobile applications typically make available, such as the type and model of device using the Application, the mobile device’s service provider, the operating system, location information, and aggregated user statistics. Cottrell’s purpose in collecting non-personally-identifying information is to be able to perform site metrics that allow us to improve the functionality of the Application. We may also monitor the most popular features of the Application. From time to time, we may release non-personally-identifying information in the aggregate, e.g. by publishing or disclosing to third parties a report on trends in the usage of the Application or of mobile applications including the Application.
  2. How We Use and Share Information.
    • To Provide Products, Services, and Information. As described above, we collect information from you so that we can communicate with you, and provide and deliver the information and services you have requested. We may use your personal information to contact you about your claims/orders, or to inform you about our other products and services available and new offerings from Cottrell. We may provide information to third-party service providers that help us process claims/orders, and fulfill and deliver products and services that you request from us.

      We may use third parties to help host the Application, send out email updates about the Application and/or Cottrell, provide marketing and advertising services for us, remove repetitive information from our user lists, and process payments. These service providers will have access to your personal information in order to provide these services, but when this occurs we implement reasonable contractual and technical protections to limit their use of that information to helping us provide the services.

      Cottrell may share data with trusted partners to help perform statistical analysis, send you email or mail, provide customer support, or as otherwise required to deliver the requested services. All such third parties are prohibited from using your personal information except to provide these services to Cottrell, and they are required to maintain the confidentiality of your information.

    • Your Consent. In addition to the sharing described elsewhere in this Privacy Policy, we will share personal information with companies, organizations or individuals outside of Cottrell when we have your consent to do so.
    • Legal Proceedings. We will share personal information with third party companies, organizations or individuals outside of Cottrell if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to: (a) meet any applicable law, regulation, subpoena, legal process or governmental request; (b) enforce applicable terms, including investigation of potential violations; (c) detect, prevent, or otherwise address fraud, security or technical issues; or (d) protect against harm to the rights, property or safety of Cottrell, our users, clients, or the public as required or permitted by law.
    • Transfer in the Event of Sale or Change of Control. If the ownership of all or substantially all of our business changes or we otherwise transfer assets relating to our business such as by merger, acquisition, bankruptcy proceeding or otherwise, we may transfer or sell your personal information to the new owner. In such a case, unless permitted otherwise by applicable law, your information would remain subject to the promises made in the then-current version of the Privacy Policy unless you agree differently.
    • Except as set forth in this Privacy Policy, we do not share, rent, license, or sell your personal information to third parties.
  3. Release of Information.

    We will not sell, trade, or rent your personally-identifiable information to others. We do provide some of our product and service offerings through contractual arrangements made with affiliates, service providers, partners and other third parties (“Service Partners”). We and our Service Partners may need to use some personally-identifiable information in order to perform tasks, or to deliver products or services to you.

    We will encourage our Service Partners to adopt and promote strong privacy policies. However, the use of your personally-identifiable information by our Service Partners is governed by the respective privacy policies of those providers, and is not subject to our control. Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. Other sites accessible through this Application, including our Service Partners, have their own privacy policies and data collection, use and disclosure practices. Please consult each site’s privacy policy. We are not responsible for the policies or practices of third parties.

  4. Tracking Disclosures.

    Neither Cottrell nor any third party engages in the collection of personally-identifiable information about your online activities over time and across third-party websites or online services when you are accessing the Application. For this reason, the Application does not respond to “Do Not Track” signals or other mechanisms providing you the ability to exercise choice regarding the collection of such information.

  5. Push Notifications.

    Cottrell may send push notifications or alerts to your device. You can deactivate these messages at any time by changing the notification settings on your Apple or Android device.

  6. Updating and Correcting Information.

    You can access and update certain information we have relating to your account by signing into your account and going to the profile section of the Application.   7. Security of Your Information.

    We use industry standard physical, technical and administrative security measures and safeguards to protect the confidentiality and security of your personal information. However, since the Internet is not a 100% secure environment, we cannot guarantee, ensure, or warrant the security of any information you transmit to us. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information. Please note that e-mails and other communications you send to us through the Application are not encrypted, and we strongly advise you not to communicate any confidential information through those means.

    Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personally-identifiable information, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) the security, integrity and privacy of any and all information and data exchanged between you and us through this Application cannot be guaranteed.

  8. . Changes to Our Privacy Policy.

    Our Privacy Policy may change from time to time. We will not reduce your rights under this Privacy Policy without your consent in accordance with applicable law. We will post any privacy policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of privacy policy changes). Your continued use of the Application available through this Application after such modifications will constitute your: (a) acknowledgment of the modified privacy policy; and (b) your agreement to abide and be bound by that privacy policy.

  9. Age Limitation.

    You must be at least 18 years old to have our permission to use this Application. Our policy is that we do not knowingly collect, use or disclose personally identifiable information about minor visitors.

  10. Effective Date and Revision Dates.

    Cottrell reserves the right, at any time and without notice, to add to, change, update or modify this Privacy Policy, by posting such change, update or modification on this Application. Any such change, update or modification will be effective immediately upon posting.

    The effective date of this Privacy Policy is October 24, 2018.
